Scheduling Mediation

In-Person or Virtual Mediation

  • Jeremy is available to mediate in-person or virtually.

  • Mediations may be booked by contacting us or by selecting an available date below.

Mediation
Preparation

  • Parties are requested to submit written statements up to 15-pages at least one week before the mediation session.  The parties may agree to the submission of longer statements.  Mediation statements are presumed to be confidential and will not be shared unless the parties agree to do so.

  • Mediation statements should include: (1) procedural history; (2) material facts and evidence; (3) key legal issues that are critical to settlement negotiation; (4) completed and remaining discovery; (4) all prior settlement discussions; and (5) any perceived obstacles to settlement.

  • Counsel for the parties are invited to meet with Jeremy by telephone for a pre-mediation conference.  These meetings are encouraged, but not required.  In many instances, issues discussed and strategized at the pre-mediation conference can save valuable hours during the mediation and can help facilitate settlement.

Mediation
Session

  • Flexibility is key for a successful mediation.  Each mediation session takes on a life of its own.   For the majority of time, each side will meet separately with Jeremy.  Joint sessions, private meetings with counsel, and other avenues of communication may also be utilized.

  • It is critical for decision makers to attend mediation.  Parties should disclose in advance who is attending with decision-making authority.  If there is a party attending with limited authority to settle, that should also be disclosed in advance.  Surprises on the day of mediation often are a hindrance to a successful resolution.

Settlement

The goal for each mediation is to reach a final resolution.  In most cases, signing a final settlement agreement at mediation is in the best interest of everyone.  Parties are strongly encouraged to prepare a form of settlement agreement ahead of the mediation session.

Follow-up

Jeremy is committed to trying to reach a settlement in all matters.  If the parties are unable to reach a resolution at the mediation session, Jeremy will conduct reasonable follow-up to try and work through the remaining issues.

Confidentiality

Confidentiality is a critical element of mediation.  All mediation participants will be required to sign a written confidentiality agreement at the outset of the mediation session.
